The facts of the case were unremarkable but James mounted a determined challenge to established CAFCASS practice, their use of in house tools, their internal safeguarding procedures and the apparent bias in the outcomes.
The Judge expressed concern about the preparation of safeguarding letters where there are counter allegations of domestic abuse. He was clear that CAFCASS need to be seen to be neutral and transparent.
The Judge also expressed concern about the reliance of CAFCASS on unpublished safeguarding tools which cannot be effectively challenged by the parties.
