Tom and Lee Stutt at Nalders Solicitors have just concluded a long running High Court dispute between an Executor and the beneficiaries of a modestly sized Estate (c. £350,000) where the Executor was seeking remuneration of c. £400,000.
Tom acted for the beneficiaries who sought falsification of the accounts and removal of the Executor under s50 of the Administration of Justice Act 1985.
This week HHJ Matthews in the Bristol District Registry of the High Court reduced the Executors remuneration to £43,000, terminated his position as Executor and ordered payment to the Beneficiaries of their costs of the litigation, which notably exceeded the Executors remuneration.
