
Melina Mukherjee secures acquittal following trial

Melina’s client provided an alcohol reading of 372 milligrams in blood, however he maintained from the outset that this was as a result of post-driving consumption.
The Crown’s case relied heavily on a witness who had reported a ‘collision’ involving the Defendant’s vehicle. However, during cross-examination the witness eventually conceded that his use of language both within his witness statement and his evidence at court (terminology such as ‘smashed’ and ‘the crash’) were nothing more than expressions. The reality was that this key witness had simply seen the Defendant in the vicinity of his vehicle with a punctured tyre and assumed that he had been drinking.
In addition, the officer in the case conceded that the prosecution’s case of drink driving rested solely on the evidence of this witness including key time frames which were rebutted by mobile phone records and an expert toxicologist’s report.
The Defendant was ultimately acquitted after trial.
Melina is currently a second-six pupil under the supervision of Francesca Whebell and Michael Brown.
