Success for Lewis Aldous at the Court of Appeal

The appellant was sentenced to 24 weeks custody at Exeter Crown Court for escaping lawful custody, drug driving, and resisting a police constable. Following a successful application to the Court of Appeal, the prison sentence was substituted for a two-year community order. Lewis successfully argued that the Crown Court failed to take account of the appellant’s significant personal mitigation and was wrong to conclude that immediate custody was the only appropriate sentence.
